Website terms, and how to request the EOR SA Ltd contract

The rules below govern your use of expandtosouthafrica.com. The commercial agreement that governs an actual EOR engagement is the EOR SA Ltd Master Services Agreement, which we email on request.

Request the EOR SA Ltd Master Services Agreement

This is the full contract you would sign with EOR SA Ltd, the South African employer of record entity that carries the statutory risk. It covers scope of services, monthly fee, invoicing, liability, IP assignment, confidentiality, data protection (POPIA + GDPR), termination and governing law.

These terms govern your use of the website expandtosouthafrica.com and any content, tools, calculators or forms hosted on it (together, the "site"). By using the site you accept these terms. If you do not accept them, please close the tab.

These terms do not by themselves create an employer-of-record relationship, a payroll relationship, a talent-sourcing engagement or any other commercial arrangement. A separate signed agreement is required for that. See section 07.

The site exists so that international employers can understand South African employment, calculate a realistic monthly cost, and decide whether to engage EOR SA Ltd via a specialist employer of record. It publishes guides, benchmarks, calculators and API documentation. It is a marketing and educational site, not a live payroll or HRIS system.

Statutory rates, thresholds, wage floors and salary benchmarks are stated with an effective date and are sourced. We do our best to keep them current and correct, and we welcome corrections at [email protected]. Nothing on the site is legal, tax or accounting advice. Use of any figure without a signed engagement is at your own risk.

Where the site quotes third-party sources (for example the CCMA, SARS, or the Department of Employment and Labour), those sources remain owned by their respective bodies. We link to them for verification.

You do not need an account to read the site. If you fill in a form (contact, calculator, sandbox request, T&C request), you agree that the details you submit are accurate and that you are entitled to share them on behalf of your company. We handle your data as described in the privacy policy.

The calculator returns an indicative monthly cost only. It is not a quote. A binding quote requires the specific role, seniority band and effective date, and is issued by EOR SA Ltd as part of a signed MSA.

All copy, graphics, logos, brand marks and code on the site are owned by Convince & Convert B.V. or licensed to it, unless a third-party attribution is clearly shown. You may quote short passages for editorial or educational purposes with a visible link back to the source page. You may not scrape the site at scale, republish full pages, or use our brand marks in a way that suggests endorsement.

IP created inside an EOR engagement (work product of the placed employee) is assigned to you under the MSA, not under these website terms.

The site is provided "as is". We do not warrant that every page is free of typos, that every rate reflects the latest gazette, or that the site is uninterrupted. To the fullest extent permitted by Dutch law, Convince & Convert B.V. is not liable for indirect, incidental or consequential loss arising out of your use of the site, including lost profits or reliance on published figures without a signed engagement.

Liability under an actual EOR engagement is capped and defined in the MSA, separately from these website terms.

The commercial relationship between you and EOR SA Ltd, if any, is governed by the EOR SA Ltd Master Services Agreement. That document covers scope, fees, invoicing, statutory contributions, liability, IP, confidentiality, POPIA + GDPR handling, employee onboarding and offboarding, and termination.

We update these terms when the site itself changes materially, for example when a new tool is added or a compliance obligation changes. The effective date at the top of the page reflects the latest revision. Meaningful changes are called out in the changelog page. Continued use of the site after an update means you accept the current version.

These website terms are governed by the laws of the Netherlands. Disputes about the website itself are subject to the exclusive jurisdiction of the courts of Amsterdam. Disputes under the MSA are governed by the law and forum set out in the MSA (South Africa).
