01Who we are
Convince & Convert B.V., registered in The Netherlands, Chamber of Commerce 42111654, operates expandtosouthafrica.com and the platform ("we"). Employment services are delivered by EOR SA Ltd, our licensed South African partner; talent sourcing by EmbedPeople B.V.
For website and client data we are the responsible party (POPIA) and controller (GDPR). For employee payroll data processed on our clients' instructions, we and EOR SA Ltd act as operator and processor respectively.
02Two frameworks, one standard
We operate under both the Protection of Personal Information Act (South Africa) and the General Data Protection Regulation (EU). Where the frameworks differ, we apply the stricter standard to everyone rather than maintaining two classes of privacy.
03What we process
Visitors: usage analytics and your currency preference.
Prospects and clients: contact details, company information and billing data.
Candidates and employees: identity documents, contract terms, and the payroll and statutory filing data that South African law requires an employer to hold.
04Why we process it
To deliver the service (contract), to meet statutory employer obligations toward SARS, the UIF and the Compensation Fund (legal obligation), to improve the product (legitimate interests), and to send hiring insights you asked for (consent, withdrawable any time).
05Where data lives
Platform data is hosted in the EU. Employment delivery requires transfers to South Africa; these rest on the European Commission's standard contractual clauses and, in the other direction, on section 72 of POPIA. A copy of our transfer safeguards is available on request.
06How long we keep it
Payroll and employee tax records: 5 years after the relevant tax year, as SARS requires.
Employment contracts: 3 years after employment ends.
Marketing data: until you unsubscribe.
Everything else: no longer than the purpose requires.
07Your rights
Access, correction, deletion, objection and portability, exercised by emailing [email protected]. Our Information Officer is Nubivio B.V.; our PAIA manual is available on request. You may complain to the Information Regulator (South Africa) or your EU supervisory authority; we would prefer you complain to us first.
